Specified Purpose
Maintaining a strong and effective Australian Defence Force (ADF) requires growth in both the capacity and capabilities of the Australian defence industry sector. The Government wants to ensure that Australian industry, including small to medium enterprises (SMEs) are given every opportunity to compete for work, based on open, transparent and accountable processes
This ePortal and Industry Capability Information System (ICIS) has been developed to assist in creating opportunities for Australian firms to do business with the Commonwealth of Australia Department of Defence. The ePortal and ICIS is a key element of Strategy 4 of the Defence and Industry Policy Statement, 2007. It contributes to the Australian Government’s Defence industry policy for increasing the participation of small to medium firms in defence procurement
Scope
These Terms of Use apply to persons undertaking a public search and registered users seeking to register and update organisation contact or capability information or provide feedback on the ePortal website.

Permission is granted (by an individual or corporation registered on this website) to the Commonwealth to reproduce the Material for the Specified Purpose on an irrevocable, non-exclusive, transferable basis on the condition that the:

General
In this Web Site:
"Commonwealth” means the Commonwealth of Australia.
“Consent” means informed consent provided under by a person registering a capability on the website on behalf of a corporation, that they understand the provisions and ramifications of this Terms of Use Statement.
“Corporation" means a body corporate that:
(a) is a foreign corporation
(b) is a trading corporation formed within the limits of Australia or is a financial corporation so formed;
(c) is incorporated in a Territory; or
(d) is the holding company of a body corporate of a kind referred to in paragraph (a), (b) or (c).
Under S52 of the Commonwealth Trade Practices Act 1974 a corporation shall not, in trade or commerce, engage in conduct that is misleading or deceptive or is likely to mislead or deceive a user of the data base that the corporation has an existing capability associated with its registration.
Under S53 of the Trade Practices Act 1974 a corporation shall not, in trade or commerce, in connection with the supply or possible supply of goods or services in connection with the promotion, by any means of the supply or use of goods or services (including through registration of a capability on the ePortal and ICIS):
(a) falsely represent that goods are of a particular standard, quality, value, grade, composition, style or model or have had a particular history or particular previous use;
(aa) falsely represent that services are of a particular standard, quality, value or grade;
(b) falsely represent that goods are new;
(bb) falsely represent that a particular person has agreed to acquire goods or services;
(c) represent that good or services have sponsorship, approval, performance characteristics, accessories, uses or benefits they do not have;
(d) represent that the corporations has a sponsorship, approval or affiliation it does not have;
(e) make a false or misleading representation with respect to the price of good or services;
(ea) make a false or misleading representation concerning the availability of facilities for the repair of goods or of spare parts for goods;
(eb) make a false or misleading representation concerning the place of origin of goods;
(f) make a false or misleading representation concerning the need for any goods or services or
(g) make a false or misleading representation concerning the existence, exclusion or effect of any condition, warranty, guarantee, right or remedy.
“Defence” means the Commonwealth of Australia, Department of Defence (ABN 68 706 814 312)
“ePortal” means this publicly searchable website, its content material and supporting functionality
“False or misleading statement / action” means a statement or action under Part V, Sections 52, 53 of the Commonwealth Trade Practices Act, 1974.
“ICIS” means the secure industry capability information system database which is used to store Material for the Specified Purpose by contractor users.
“Contractor user” means a registered user that is linked to company.
"Informed consent” means
“Linked Web Sites" means web sites of persons or entities other than Defence, Fujitsu Australia Limited or those of Australian and New Zealand companies registered on this website.
"Operator” means Fujitsu Australia Limited, the organisation responsible for industry secure hosting of this website.
“Personal Information" means any information from which your identity or that of your registered company is apparent or can be reasonably be ascertained.
“Purpose” means creating opportunities for Australian (including New Zealand) firms to do business with Defence
"Registered user” means a person registered to use the ePortal and thus is able to access more information and functionality than the un-registered browser of the site.
“Third party” means a person authorised to undertake capability registrations on behalf of a number of companies
“Web Site" means the whole or any part of the web pages located at www.idlink.com.au (including the lay-out of this Web Site, individual elements of the Web Site design, underlying code elements of this Web Site, or text, sounds, graphics, animated elements or any other content of this Web Site.)
"We" and "us" refer to Defence, and "our" has the same meaning. These Terms of Use are governed by the laws in force in the Australian Capital Territory, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory, Australia and any courts that may hear appeals from those courts.
“Yaffa Publishing” is the publisher of Australian Defence Magazine (ADM) from whom Fujitsu will source the initial upload of company contact and capability data.
Nothing contained in these Terms of Use derogates from Defence’s right to comply with law enforcement requests or requirements relating to your use of this Web Site or information provided to or gathered by Defence with respect to that use.
We will only record your e-mail address if you send us a message. It will only be used for the purpose for which you have provided it and will not be added to a mailing list unless supplied for that reason. We will not use your e-mail address for any other purpose, and will not disclose it, without your consent. This site contains links to other sites.
